Chapter I General rules
Article 1 These Provisions are formulated in accordance with the Law of the People's Republic of China on Production Safety and the Regulations on the Safety Administration of Hazardous Chemicals and other relevant laws and administrative regulations for the purpose of strengthening the safety supervision and administration of major hazardous chemicals, preventing and reducing the occurrence of hazardous chemical accidents, and ensuring the safety of people's lives and property.
Article 2 These Provisions shall apply to the identification, evaluation, registration, filing, filing, verification and supervision of major hazardous sources of hazardous chemicals of units engaged in the production, storage, use and operation of hazardous chemicals (hereinafter referred to as hazardous chemicals units).
These Provisions shall not apply to the safety supervision and administration of urban gas, major hazard sources of hazardous chemicals used for national defense scientific research and production, and major hazard sources of hazardous chemicals in port areas.
Article 3 The term "major hazard sources of hazardous chemicals" (hereinafter referred to as "major hazard Sources") as mentioned in these Provisions refers to the units (including sites and facilities) that are identified and determined according to the "Identification of Major Hazard Sources of Hazardous Chemicals" (GB18218) standard, and the amount of hazardous chemicals produced, stored, used or transported is equal to or exceeds the critical amount.
Article 4 A hazardous chemical unit shall be the main body responsible for the safety management of major hazard sources of its own unit, and its main person in charge shall be responsible for the safety management of major hazard sources of its own unit, and ensure the safety investment necessary for the safe production of major hazard sources.
Article 5 The safety supervision and administration of major hazard sources shall implement the principle of combining territorial supervision and hierarchical management.
The departments of production safety supervision and administration of the local people's governments at or above the county level shall, in accordance with relevant laws, regulations, standards and these provisions, conduct safety supervision and administration of major hazard sources within their jurisdiction.
Article 6 The State encourages hazardous chemical units to adopt advanced and applicable processes, technologies, equipment and automatic control systems that are conducive to improving the safety guarantee level of major hazards, and promotes the informatization construction of the safety supervision and control of major hazards by the work safety supervision and administration departments.
Chapter two identification and evaluation
Article 7 A unit of hazardous chemicals shall, in accordance with the standards of Identification of Major Hazards of Hazardous Chemicals, identify major hazards in its equipment, facilities or sites for the production, management, storage and use of hazardous chemicals, and record the identification process and results.
Article 8 Units of hazardous chemicals shall conduct safety assessments of major hazard sources and determine the grade of major hazard sources. A hazardous chemical unit may organize its registered safety engineers and technicians or hire relevant experts to conduct safety assessment, or it may entrust a safety assessment institution with corresponding qualifications to conduct safety assessment.
In accordance with the provisions of laws and administrative regulations, hazardous chemical units need to carry out safety assessment, major hazard safety assessment can be carried out together with the safety assessment of the unit, with a safety assessment report instead of a safety assessment report, or a separate major hazard safety assessment can be carried out.
Major hazards are classified into level I, Level II, level III and level IV according to their degree of danger, with level I being the highest level. The classification methods of major hazard sources are listed in Annex 1 of these Provisions.
Article 9 In any of the following circumstances, a safety assessment institution with appropriate qualifications shall be entrusted to conduct a safety assessment according to the provisions of relevant standards using quantitative risk assessment methods to determine the individual and social risk value:
(A) constitutes a primary or secondary major hazard source, and the sum of the ratio of the actual existence (online) of toxic gas to the critical amount specified in the Identification of Major Hazard Sources of Hazardous Chemicals is greater than or equal to 1;
(2) constitutes a major hazard source, and the sum of the ratio of the actual (online) amount of explosive or liquefied flammable gas to the critical amount specified in the Identification of Major Hazard Sources of Hazardous Chemicals is greater than or equal to 1.
Article 10 The safety assessment report of major hazard sources shall be objective and fair, with accurate data, complete content, clear conclusions and feasible measures, and shall include the following contents:
(1) the main basis for the assessment;
(2) Basic information on major hazard sources;
(3) the possibility of the accident and the degree of harm;
(d) individual risk and social risk value (only applicable to quantitative risk assessment methods);
(5) Surrounding sites and personnel that may be affected by the accident;
(6) Conformity analysis of identification and classification of major hazard sources;
(7) safety management measures, safety technology and monitoring measures;
(8) emergency measures for accidents;
(9) Evaluation conclusions and recommendations.
Where a hazardous chemical unit replaces a safety assessment report with a safety assessment report, the contents of the safety assessment report concerning major hazard sources shall comply with the requirements stipulated in paragraph 1 of this article.
Article 11 Under any of the following circumstances, hazardous chemical units shall re-identify, assess and grade major hazards:
(1) The safety assessment of major hazard sources has been completed for three years;
(2) Construction, reconstruction or expansion of installations, facilities or sites that constitute major sources of danger;
(3) Changes in the type, quantity, production, use technology or storage mode of hazardous chemicals, as well as important equipment and facilities, which affect the level of major hazard sources or the degree of risk;
(4) external production safety environmental factors have changed, affecting the level of major hazard sources and risk degree;
(5) The occurrence of hazardous chemical accidents causing death, or more than 10 people injured, or affecting public safety;
(6) Changes in national standards and industry standards related to the identification and safety assessment of major hazards.
Chapter III Safety management
Article 12 Units of hazardous chemicals shall establish and improve safety management rules and regulations and safety operation procedures for major hazards, and take effective measures to ensure their implementation.
Article 13 A unit of hazardous chemicals shall, in accordance with the actual situation of the types, quantities, production and use processes or related equipment and facilities of hazardous chemicals constituting major hazard sources, establish and improve the safety monitoring and monitoring system and improve the control measures in accordance with the following requirements:
(a) major hazards are equipped with temperature, pressure, liquid level, flow, components and other information of the uninterrupted collection and monitoring system and flammable gas and toxic and harmful gas leakage detection and alarm device, and with information transmission, continuous record, accident early warning, information storage and other functions; Class I or Class II major hazard source, with emergency stopping function. The recorded electronic data shall be kept for at least 30 days;
(b) major hazard chemical production equipment to meet the requirements of safety production automation control system; Class I or Class II major hazards, equipped with an emergency stopping system;
(3) Setting up emergency cut-off devices for key facilities such as toxic gases, highly toxic liquids and inflammable gases in major dangerous sources; Facilities for toxic gases shall be equipped with emergency disposal devices for leakage. Primary or secondary major hazard sources involving toxic gases, liquefied gases and highly toxic liquids, equipped with an independent safety instrumentation system (SIS);
(4) Places or facilities where highly toxic substances are stored in major dangerous sources, and video surveillance systems are set up;
(5) Safety monitoring monitoring system meets the provisions of national standards or industry standards.
Article 14 The individual and social risk values of major hazard sources determined by quantitative risk assessment shall not exceed the individual and social acceptable risk limits listed in Annex 2 of these provisions.
If it exceeds the permissible risk limit standard of individuals and society, the hazardous chemical unit shall take corresponding risk reduction measures.
Article 15 Units of hazardous chemicals shall, in accordance with the relevant provisions of the State, regularly test and inspect the safety facilities and safety monitoring and monitoring systems of major hazards, and carry out regular maintenance and maintenance to ensure the effective and reliable operation of the safety facilities and safety monitoring and monitoring systems of major hazards. Maintenance, maintenance and testing shall be recorded and signed by the relevant personnel.
Article 16 Hazardous chemical units shall clarify the responsible persons or responsible institutions of key installations and key positions in major hazard sources, and carry out regular inspections of the safety of major hazard sources, and take timely measures to eliminate hidden dangers of accidents. If the hidden danger of the accident is difficult to be immediately eliminated, a management plan should be formulated in time to implement rectification measures, responsibilities, funds, time limits and plans.
Article 17 The hazardous chemicals unit shall provide safe operation skills training for the personnel in the positions of management and operation of major hazards, so that they can understand the dangerous characteristics of major hazards, be familiar with the rules and regulations of safety management of major hazards and safe operation procedures, and master the safe operation skills and emergency measures of the post.
Article 18 Units of hazardous chemicals shall set up obvious safety warning signs at the places where major hazard sources are located, indicating the emergency treatment measures in case of emergency.
Article 19 A unit of hazardous chemicals shall inform, in an appropriate manner, the units, regions and persons that may be affected of the possible accident consequences and emergency measures of major hazardous sources.
Article 20 Hazardous chemical units shall, according to law, formulate emergency plans for major hazard accidents, establish emergency rescue organizations or equip emergency rescue personnel, equip necessary protective equipment and emergency rescue equipment, equipment and materials, and ensure their good condition and convenient use; Cooperate with the production safety supervision and administration department of the local people's government to formulate the emergency plan of the hazardous chemical accident involving the unit in the region.
For major hazardous sources of inhaled toxic and harmful gases, hazardous chemical units shall be equipped with portable concentration testing equipment, air breathing apparatus, chemical protective clothing, leakage plugging equipment and other emergency equipment and equipment; Major hazards involving highly toxic gases should also be equipped with more than two sets (including this number) of airtight chemical protective clothing; Major hazards involving flammable and explosive gases or flammable liquid vapors shall also be equipped with a certain number of portable combustible gas detection equipment.
Article 21 A hazardous chemical unit shall formulate an emergency plan exercise plan for a major hazard accident, and conduct an emergency plan exercise in accordance with the following requirements:
(1) A special emergency plan for major danger sources shall be carried out at least once a year;
(2) The on-site disposal plan for major hazard sources shall be carried out at least once every six months.
After the completion of the emergency plan drill, the hazardous chemical unit shall evaluate the effect of the emergency plan drill, write an emergency plan drill evaluation report, analyze the existing problems, put forward revised opinions on the emergency plan, and revise and improve it in time.
Article 22 Hazardous chemical units shall register and file the identified major hazard sources in a timely and item-by-item manner.
The archives of major hazard sources shall include the following documents and materials:
(1) Identification and classification records;
(2) A list of basic characteristics of major hazard sources;
(3) Safety technical specifications of all chemicals involved;
(4) regional location map, layout plan, process flow chart and list of main equipment;
(5) major hazard safety management rules and regulations and safety operation procedures;
(6) safety monitoring monitoring system, measures, testing, inspection results;
(7) Emergency plans, evaluation opinions, exercise plans and evaluation reports for major hazard accidents;
(8) Safety assessment report or safety assessment report;
(9) Names of responsible persons and responsible institutions of key installations and key positions of major hazard sources;
(10) the setting of safety warning signs at major hazard sites;
(11) Other documents and materials.
Article 23 Within 15 days after the completion of the major hazard safety assessment report or the safety assessment report, the hazardous chemical unit shall fill in the application form for the record of major hazard sources, together with the major hazard source archival materials provided in Article 22 of these provisions (of which the document information provided in the fifth paragraph of the second paragraph only needs to provide a list). It shall be submitted to the production safety supervision and administration department of the local county-level people's government for the record.
The production safety supervision and administration department of the county-level people's government shall submit the record materials of the first and second major hazard sources within the jurisdiction to the production safety supervision and administration department of the people's government of the city divided into districts every quarter. The production safety supervision and administration department of the municipal people's government divided into districts shall submit the first-level major hazard sources within the jurisdiction of the record materials to the production safety supervision and administration department of the provincial people's government every six months.
In case of any of the situations listed in Article 11 of these provisions, the hazardous chemical unit shall update its archives in a timely manner and file a new record with the production safety supervision and administration department of the local people's government at the county level.
Article 24 The construction, reconstruction and expansion of hazardous chemical construction projects of hazardous chemical units shall complete the identification, safety assessment and classification, registration and filing of major hazard sources before the completion and acceptance of the construction projects, and file with the safety supervision and administration department of the local people's government at the county level.
Chapter IV Supervision and inspection
25th production safety supervision and administration departments of the people's governments at the county level shall establish and improve the management system of major hazards of hazardous chemicals, identify responsible personnel, and strengthen data archiving.
Article 26 The production safety supervision and administration department of the county-level people's government shall, before January 15 of each year, submit the summary information of major hazard sources within the jurisdiction of the previous year to the production safety supervision and administration department of the people's government of the city divided into districts. The production safety supervision and administration department of the municipal people's government divided into districts shall, before January 31 of each year, submit the summary information of major hazard sources within the jurisdiction of the previous year to the production safety supervision and administration department of the provincial people's government. The work safety supervision and administration department of the people's government at the provincial level shall, before February 15 of each year, submit the summary information of major hazard sources within the jurisdiction of the previous year to the State Administration of Work Safety Supervision and Administration.
27th major hazard source after safety assessment or safety assessment no longer constitute a major hazard, hazardous chemical units shall apply to the local county level people's government safety supervision and administration department for cancellation.
The following documents and materials shall be submitted for writing off major hazard sources:
(1) An application indicating the reasons for cancellation;
(2) Name of the unit, legal representative, address, contact person and contact information;
(3) Safety assessment report or safety assessment report.
Article 28 The production safety supervision and administration department of the people's government at the county level shall, within 30 days from the date of receipt of the documents and materials applied for verification, verify and issue certificates if the conditions are met; If the applicant does not meet the requirements, explain the reasons and inform the applicant in writing. When necessary, the supervision and administration department of production safety of the people's government at the county level shall engage relevant experts to carry out on-site verification.
Article 29 The production safety supervision and administration department of the people's government at the county level shall submit the verification materials of the first and second major hazard sources within the jurisdiction to the production safety supervision and administration department of the people's government of the city divided into districts every quarter. The production safety supervision and administration department of the municipal people's government divided into districts shall submit the verification materials of major hazard sources within the jurisdiction to the production safety supervision and administration department of the provincial people's government every six months.
Article 30 The production safety supervision and administration departments of the local people's governments at or above the county level shall strengthen the supervision and inspection of hazardous chemical units with major hazard sources, and urge hazardous chemical units to do a good job in the identification of major hazard sources, safety assessment and classification, registration and filing, monitoring and control, preparation of emergency plans for accidents, verification and safety management.
The supervision and inspection of major hazard sources for the first time shall include the following main contents:
(1) the operation of major hazard sources, the formulation and implementation of safety management rules and regulations and safety operation procedures;
(2) Identification, classification, safety assessment, registration and filing of major hazard sources;
(3) Monitoring and monitoring of major danger sources;
(4) the detection, inspection and maintenance of major hazard safety facilities and safety monitoring and monitoring systems;
(5) the preparation, review, filing, revision and exercise of emergency plans for major hazard accidents;
(6) the safety training and education of relevant employees;
(7) the setting of safety signs;
(8) Emergency rescue equipment, equipment and supplies;
(9) The implementation of accident prevention and control measures.
